END USER LICENSE AGREEMENT (EULA) FOR PIXIE APP

IMPORTANT: PLEASE READ THIS END USER LICENSE AGREEMENT CAREFULLY BEFORE USING THE PIXIE APP ("THE APP"). BY USING THE APP, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, DO NOT INSTALL, ACCESS, OR USE THE APP.

1. GRANT OF LICENSE:

Subject to the terms and conditions of this Agreement, the Pixie App grants you a limited, non-exclusive, non-transferable, and revocable license to install, access, and use the App for personal, non-commercial purposes on a compatible device.

2. INTELLECTUAL PROPERTY:

The App, including but not limited to its design, source code, graphics, and content, is owned by Pixie App or its licensors and is protected by intellectual property laws. You acknowledge and agree that all rights, title, and interest in the App, including any modifications or derivative works, are and shall remain the exclusive property of Pixie App.

3. RESTRICTIONS:

You shall not:

   a. Copy, modify, distribute, or create derivative works of the App;

   b. Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App;

   c. Remove, alter, or obscure any copyright, trademark, or other proprietary notices on the App;

   d. Use the App for any illegal, unauthorized, or prohibited purpose;

   e. Use the App in a manner that infringes upon the rights of others;

   f. Use the App to transmit or store any viruses, malware, or harmful code;

   g. Interfere with or disrupt the operation of the App or its servers;

   h. Use the App to collect or process personal information without appropriate consent and compliance with applicable privacy laws.

4. PRIVACY:

Pixie App respects your privacy and handles personal data in accordance with its Privacy Policy. By using the App, you consent to the collection, use, and disclosure of your information as described in the Privacy Policy.

5. DISCLAIMER OF WARRANTIES:

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. PIXIE APP DOES NOT WARRANT THAT THE APP WILL MEET YOUR REQUIREMENTS OR THAT ITS OPERATION WILL BE UNINTERRUPTED OR ERROR-FREE.

6. LIMITATION OF LIABILITY:

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PIXIE APP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THE USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

7. TERMINATION:

This Agreement is effective until terminated. Pixie App may terminate this Agreement at any time if you fail to comply with its terms. Upon termination, you must cease all use of the App and destroy all copies in your possession.

8. GOVERNING LAW AND JURISDICTION:

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction where Pixie App operates. Any legal action or proceeding arising out of or related to this Agreement shall be brought exclusively in the competent courts of that jurisdiction.

9. ENTIRE AGREEMENT:

This Agreement constitutes the entire agreement between you and Pixie App regarding the App and supersedes all prior or contemporaneous understandings or agreements, whether written or oral.

10. SEVERABILITY:

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

BY INSTALLING, ACCESSING, OR USING THE PIX

IE APP, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD THIS AGREEMENT AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS.
