TERMS AND CONDITIONS FOR THE USE OF PIXIE APP

These Terms and Conditions ("Agreement") govern your use of the Pixie App ("the App"), provided by Pixie App. By using the App, you agree to comply with and be bound by the terms and conditions outlined in this Agreement. If you do not agree to these terms and conditions, you may not use the App.

1. USE OF THE APP:

a. Eligibility: You must be of legal age in your jurisdiction or have parental/guardian consent to use the App.

b. User Account: Some features of the App may require you to create a user account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

c. Prohibited Conduct: You shall not use the App in any way that violates applicable laws or infringes upon the rights of others. Prohibited conduct includes but is not limited to:

   i. Unauthorized access or use of the App or its servers;

   ii. Circumventing or disabling any security measures or technological protections of the App;

   iii. Uploading, transmitting, or sharing any content that is illegal, harmful, defamatory, or infringing;

   iv. Engaging in any activity that disrupts or interferes with the functioning of the App.

2. CONTENT:

a. User-Generated Content: The App may allow you to upload, submit, or share content. You retain ownership of any intellectual property rights in such content. By uploading, submitting, or sharing content, you grant Pixie App a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, adapt, and distribute the content for the purposes of operating and improving the App.

b. Prohibited Content: You shall not upload, submit, or share any content that is illegal, harmful, offensive, or infringing upon the rights of others.

c. Content Monitoring: Pixie App reserves the right to monitor, review, or remove any content from the App at its sole discretion.

3. INTELLECTUAL PROPERTY:

a. Ownership: The App and all its content, including but not limited to text, graphics, logos, and software, are the property of Pixie App and its licensors and are protected by intellectual property laws.

b. Trademarks: All trademarks, service marks, logos, and trade names displayed in connection with the App are the property of their respective owners. You are prohibited from using any trademarks without prior written consent from the respective owner.

4. DISCLAIMER OF WARRANTIES:

a. General Disclaimer: The App is provided on an "as is" and "as available" basis. Pixie App makes no warranties or representations, express or implied, regarding the App's accuracy, reliability, or suitability for any purpose.

b. Third-Party Content: The App may contain links to third-party websites or resources. Pixie App does not endorse or control such content, and you access and use it at your own risk.

5. LIMITATION OF LIABILITY:

a. Indirect Damages: To the maximum extent permitted by applicable law, Pixie App shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to the use of the App.

b. Direct Damages: In no event shall Pixie App's total liability for any claims arising under this Agreement exceed the amount paid by you, if any, for accessing or using the App.

6. MODIFICATIONS AND TERMINATION:

Pixie App reserves the right to modify, suspend, or terminate the App or any part thereof at any time, with or without notice. Pixie App may also modify these Terms and Conditions from time to time, and it is your responsibility to review the updated terms. Continued use of the App

 after any modifications shall constitute your acceptance of the modified terms.

7. GOVERNING LAW AND JURISDICTION:

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction where Pixie App operates. Any legal action or proceeding arising out of or related to this Agreement shall be brought exclusively in the competent courts of that jurisdiction.

8. ENTIRE AGREEMENT:

This Agreement constitutes the entire agreement between you and Pixie App regarding the App and supersedes all prior or contemporaneous understandings or agreements, whether written or oral.
